Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website operated by Whats Going On London Ltd, trading as What's Going On (company number 17107610, registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ) (“we”, “us”, “our”), accessible at whatsgoingon.london (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Description of the Service

What's Going On is a free events discovery platform that aggregates publicly available event listings from a variety of third-party sources across London. We display this information on an interactive map to assist users in discovering events in their area. The Service is provided for informational purposes only.

2. Accuracy of event information

Event details displayed on the Service — including but not limited to dates, times, prices, descriptions, images and venue information — are sourced from third-party platforms and venue websites. While we endeavour to present accurate and current information:

  • We make no warranty or representation as to the accuracy, completeness, reliability or timeliness of any event listing
  • Events may be cancelled, rescheduled, relocated or otherwise modified by the organiser without prior notice to us
  • Prices displayed are indicative only and may differ from the price charged at the point of sale
  • You are solely responsible for verifying all details with the original source, venue or organiser before making any arrangements or purchases in reliance upon information obtained through the Service

3. Ticketing and third-party transactions

The Service does not sell tickets, process payments or facilitate bookings of any kind. Where you follow a link from the Service to a third-party website to purchase tickets or make a booking, any resulting transaction is entered into solely between you and that third party and is governed exclusively by that third party's terms and conditions.

We accept no responsibility or liability for any issues arising from ticket purchases, refunds, cancellations or disputes with any third-party platform or event organiser.

4. User accounts

You may create an account to access certain features of the Service, including bookmarking events, saving venues and storing search preferences. By creating an account, you agree that:

  • You are responsible for maintaining the confidentiality and security of your account credentials
  • You are responsible for all activity that occurs under your account
  • You will provide accurate and complete information during registration and keep such information up to date
  • You will notify us promptly of any unauthorised access to or use of your account

We reserve the right to suspend, disable or permanently delete any account at our sole discretion, including where we reasonably believe that a user has violated these Terms or is using the Service for abusive, fraudulent or unlawful purposes.

5. Acceptable use

You agree that you will not:

  • Use any automated means — including bots, scrapers, crawlers or similar technology — to access, extract or index data from the Service without our prior written consent
  • Attempt to gain unauthorised access to our systems, infrastructure, databases or any other user's account
  • Use the Service to transmit, distribute or store any material that is unlawful, harmful, threatening, defamatory or otherwise objectionable
  • Interfere with, disrupt or impose an unreasonable burden on the Service or its underlying infrastructure
  • Reproduce, redistribute, sublicense or commercially exploit any part of the Service without our express written permission
  • Circumvent, disable or otherwise interfere with any security or access-control features of the Service

6. Intellectual property

The design, source code, branding, logos and overall look and feel of the Service are our proprietary intellectual property and are protected by applicable copyright, trademark and other intellectual property laws. You may not copy, modify, distribute or create derivative works based upon any part of the Service without our prior written consent.

Event content — including titles, descriptions and images — is the property of the respective event organisers, venues and third-party platforms from which it originates. We display such content for informational purposes and provide attribution by linking to the original source.

7. Content removal requests

If you are a venue owner, event organiser, rights holder or representative of a third-party platform and believe that content displayed on the Service infringes your intellectual property rights or should otherwise be removed, please contact us at hello@whatsgoingon.london with details of the content in question. We will review and action all removal requests promptly.

8. Disclaimer of warranties

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. Without limiting the foregoing:

  • We do not warrant that the Service will be available, uninterrupted, timely, secure or error-free
  • We do not warrant that any information obtained through the Service will be accurate or reliable
  • We do not warrant that defects in the Service will be corrected

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages arising out of or in connection with your access to or use of (or inability to access or use) the Service, including but not limited to:

  • Any loss, damage or inconvenience resulting from reliance on event information displayed on the Service
  • Any loss arising from transactions with third-party platforms or event organisers
  • Any loss of data, profits, goodwill or other intangible losses
  • Any damage caused by viruses, malware or other technologically harmful material that may infect your equipment as a result of your use of the Service

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

10. Third-party links and services

The Service contains hyperlinks to third-party websites, platforms and services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, practices or availability of any third-party websites or services. Your interaction with any third-party website or service is at your own risk and is subject to that third party's terms and conditions.

11. Indemnification

You agree to indemnify, defend and hold harmless What's Going On and its operators, affiliates, officers, employees and agents from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to the Service and Terms

We reserve the right to modify, suspend or discontinue the Service (or any part thereof) at any time, with or without notice, and without liability to you. We may also revise these Terms from time to time. The most current version will always be available on this page with an updated effective date. Your continued use of the Service following the publication of revised Terms constitutes your acceptance of such changes.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, disclaimers, indemnification and limitations of liability.

14. Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

15. Waiver

The failure of What's Going On to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorised representative.

16. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and What's Going On with respect to your use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.

17. Governing law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
